Michael Dunn, George Zimmerman, and Fear

I wonder if any black person has ever had the benefit of  having a trial with an impartial jury.

The Sixth Amendment of the Constitution says that American citizens are entitled to a trial with an “impartial jury.” That  phrase has been interpreted as one having the right to a trial with a jury “by one’s peers.” That’s not exactly what the Constitution says. It says we’re supposed to have trials with an “impartial jury.”

I have long struggled with trials for black people that have had juries which were nearly all white. Because I thought the Constitution said we have a right to a jury of our peers, I have long thought that something was very wrong. Well, there’s a lot wrong, but for this moment, I just want to concentrate on the one thing I felt was wrong: Black people were NOT having trials with juries “of their peers.”

But along those same lines, black people have not had many trials with impartial juries, either. In the Dunn trial, there were four white men, four white women, two black women …one Asian woman and one Hispanic American. Were these jurors impartial? I don’t think so. Out of the total of 12 jurors, 8 were white. Impartial?  I cannot believe that they were.

Chris Cuomo of CNN interviewed George Zimmerman, who was acquitted of killing Trayvon Martin. Zimmerman, in spite of being free, is pouting. He says HE is a victim and was made a scapegoat by the government, naming the president and the attorney in general. Michael Dunn is amazed that he was convicted even of attempted second degree murder. He said from jail that he was attacked. Apparently, the juries believed both these men, that THEY were victims. I cannot believe that that the jurors who saw him as victim …are impartial.

White people are so often afraid of black people…just because they are black and because the media has been very effective in portraying black people as criminals.  Almost every black person I know has experienced a white person gripping her bag more tightly when she has seen a black person, primarily a black man, approaching her. It is a fact that one can be (and is) stopped just because he is black.  Statistics show that while blacks commit a large number of violent crimes, most of their victims tend to be black. A report done by CNN indicated that the most likely victim of black crime is a black male, 12-19 years old, and the least likely victim, a white male, ages 35-64.  Blacks, in relation to being only 12.5 percent of the population, commit “a disproportionate number of crimes,” but, the report said, “whites commit more crimes.” (http://money.cnn.com/magazines/moneymag/moneymag_archive/1994/06/01/88911/)

Blacks have been criminalized historically, something that began after Reconstruction, when white people in the South needed a way to get blacks back on the farms to do the work that would improve the South’s economy. Blacks could be arrested for the most petty things – like being outside too late, or walking on the wrong side of the railroad tracks, for loitering (even as they waited in line to get a job!) The message was being given that black people were bad, unworthy of freedom. That sentiment has persisted…

The overarching feeling of many whites, then, is that black people are bad and are to be feared, and fear drives white emotions, beliefs and actions. Why did the man in Dearborn, Michigan, shoot 19-year-old Renisha McBride in the face as she banged on his door in the wee hours of the morning seeking help? Because he was afraid. Why did the police officer shoot injured and unarmed Jonathan Ferrell as he ran toward police, seeking help? Because he was afraid.

Both Michael Dunn and George Zimmerman are murderers; they both shot unarmed black teens …but their actions were driven by fear and they had jurors who were ALSO afraid, or who know the fear of which they spoke, and in the cradle of that fear, acquitted these men of their crimes. The juries were NOT impartial. Fear prevented that.

When I hear Dunn and Zimmerman say they were victims, my blood boils. They were not victims of anything other than their own fear.  Fear leads people to insecurity and irrational actions…which is what we saw in the case of both these men.

Somebody on the Dunn jury was connecting with his/her own fear…and that’s what drove them. Dunn is still shocked that he was convicted of anything, given the scenario as he feels it happened. He was afraid of Jordan Davis, afraid of what he believes to be true of all black people. His fear, probably fed a bit by machismo, increased as Davis offered him an angry challenge to Dunn’s request that the teens turn down their money. Dunn  rode into that gas station with contempt for and fear of black people in his heart. He acted on both…and contrary to his sorry claim, he was NOT the victim; he was NOT attacked. That 17-year- old kid was the victim and was attacked and killed.

I get that. But the jury, which was NOT impartial, did not.

It’s a sorry and tragic shame, what has happened.

When We Are Unwilling to Struggle

Joan Chittister writes in her book, Scarred by Struggle, Transformed by Hope, that Western civilization, “and the United States in particular, has developed to the point where pain is unacceptable.”   Because of that, our country is unwilling to struggle with the things which are always with us. Racism is one of those things. It sits in the middle of everything we do, like a grinning Cheshire cat, knowing that it does not have to worry about being confronted honestly. Many will say that even the mention of racism is foolhardy, that it is gone and has been for a long time. Those who pull “the race card” are immediately ostracized and criticized.

And yet, the Cheshire cat stays amongst us. In this last presidential campaign, the cat walked quietly yet persistently into campaign rhetoric, shaping words that belied the rancid presence of racism. Bill O’Reilly, after President Obama, said “Obama wins because it’s not a traditional America anymore,” he said. “The white establishment is the minority. People want things.”

The entitlements that Republicans want to slash help poor, black and brown people but a whole heap of poor white people as well.   There is a resentment there, always right below the surface. People who are on government assistance are viewed as leeches. They want “things,” as O’Reilly said.  I guess well-to-do people don’t want things? Isn’t having “things” part of what America is about? And those who do not have the things that they see the well-to-do, or at least comfortable, people have yearn for the day when they’ll be able to have those things too. That is part of the capitalist ethos, isn’t it?

The Cheshire cat grins and walks quietly away. America will not struggle, will not confront her, and she knows it.

We don’t like to struggle, and yet it is through struggle that we become whole. Struggle happens when we confront ourselves, our weaknesses, our issues, our fears, our fears. Struggle happens when we see ourselves for who we are, not for what we would like to be. When we refuse to struggle, our issues clog us up.  We are always on defense, always trying to justify ourselves and where we are. We do not grow if we refuse to struggle.

America is not nearly the nation she could be, because we refuse to struggle with this dogged racism. The Republicans have awakened; the nation is not lily white anymore. They will have to pay attention to people of many colors and hues. Demographics. Mitt Romney lost  to every demographic except for white people  We as a nation do not want to struggle…

And we as individuals, many of us, refuse to struggle and so are not nearly what we could be.

Chittister says that “struggle is not one thing; it is many things.”  The things with which we refuse to struggle are toxic and can pull us into pits so deep we cannot get out.  We refuse to admit that we are not perfect, and we refuse to get help to address our imperfections. That causes deep pain. Individuals try to get rid of the pain by overeating, taking prescription meds, doing drugs…anything to stop the pain. But because pain cannot and will not go away until we walk into the chaos instead of running away from it, we have to keep on doing self-destructive things in order to breathe without hurting.

Our country lives in denial. We as a nation deny that racism is as rancid as it is, that it permeates everything we do. We have tried, consistently, to push it under the carpet, but it doesn’t stay.  “This country is more divided now than it has ever been,” I heard Mary Matalin, a Conservative, Republican pundit say, She said that President Obama made it so.

The Cheshire cat grins …

I am not at all convinced that America will ever seriously deal with racism, because we keep ingesting and digesting denial. We keep the toxicity of racism with us, even though we deny it’s there.

But I would hope that we as individuals, those of us in the midst of a struggle and those of us who are avoiding a struggle in which we need to engage, would not follow our country’s example and struggle as we need to in order to grow and to become new. Chittister says that “hurt may actually be a part of the process of life.” If we find the root of our pain, we can do what we need in order to get it out, or at least take away its power. If we don’t address and treat our pain, it grows and metastasizes. like a cancer.

If we are unwilling to struggle, we cannot feel the joy of being freed from the grip of our issues. Chittister quotes Helen Keller, who wrote, “The hilltop hour would not be half so wonderful if there were no dark valleys to traverse.”

If we are unwilling to struggle, we stay in the valleys. Because of her denial of racism, America sits in a valley, not even traversing. Just sitting.

African-Americans and PTSD

In  book that I am writing, I offer the opinion that African-Americans have suffered or do suffer from post traumatic stress disorder due to racism.

Somebody will groan, but the possibility of this being very true is real. Racism, or acts of violence due to racism, have done nothing short of creating terror in the hearts of individuals and the African-American community as a whole.

I can remember my mother telling us to be careful and to be wary of police officers, because they were not “always on the side of African-Americans.” I can remember doing stories as a reporter where individuals had been terrorized, brutalized by police, but were afraid to talk about it.

In earlier times, African-Americans were terrorized by the ever-present possibility of being lynched, with no legal protection against the same. In fact, it very often turned out that those who participated in lynchings or those in the Ku Klux Klan were members of the judicial system, charged to protect all citizens. That “all” did not include African-Americans.

African-Americans have seen loved ones cut down by law enforcement officers and get away with it. Neither the courts nor the jury system have been particularly “safe” these members of American society.

An article I read in The New England Journal of Medicine said that symptoms of PTSD include high anxiety,depression, bouts of anger…maladies which are all too often found in the African-American community in large numbers.

African-Americans have learned to cope and to push through the barriers put in place by institutional and structural racism, but the end-result of having to fight harder than the majority population for a “place” in this society, for decent and right treatment, for civil rights…has been a group of people who have developed a specialized set of coping mechanisms. We are here not because of the U.S. Constitution, and have made gains not because of the Constitution or of democracy, but in spite of those two supposed guarantees.

My musings on this made me think about what America would be like if such a large segment of its population were not working with and through PTSD. Even our children, caught too often in poor public schools in horrible condition that legislators seem to care nothing about, suffer. From the time they come out of the  womb, people who are “pro-life” turn their backs on them and begin to count them as part of the banes of our society, participants in entitlement programs that are considered a waste of American dollars.

I am not sure of the treatment for PTSD, but I do know that when people are traumatized, it causes a change in behavior. What the mind has seen and internalized cannot be extinguished or erased. There are people who have been traumatized in a number of different ways, years ago, who are still suffering as though the trauma happened only yesterday.

If it is (and I think it is) the case that African-Americans suffer from PTSD due to racism, how can it be fixed?  It seems pretty clear to me that if such a large segment of our nation is suffering from a disorder due to the way racism has flourished in this country, that something ought to be done about it so that we do not keep on repeating acts of domestic terrorism, albeit more subtle than before, that adversely affect citizens of our nation.

It seems to be that no nation can be as great as it has been intended to be if any segment of its population is so systematically and consciously terrorized and basically ignored.

Anybody Want Healing?

Sometimes, I need help to understand why some things are as they are…like this: why do some white people think it’s racist to acknowledge that racism exists and to talk about it?

I have been chewing on that ever since I had an online chat with a white friend who was furious with me for saying that, at the beginning of the GOP race for the presidential nomination, Newt Gingrich was “playing to his base.”

That base was in the South, and consisted primarily, as far as I could tell, of white people. Many of them resonated with Gingrich’s assertions that black people and their situation in America were surely to be considered; in a speech in New Hampshire he made in January he said “… the African-American community should demand paychecks and not be satisfied with food stamps.” (http://www.huffingtonpost.com/2012/01/05/newt-gingrich-paychecks-food-stamps_n_1188193.html)

That comment, along with others, such as “President Obama is the food stamp president” are no less disparaging and inaccurate about the lives of African-Americans than was President Reagan’s creation of  the “welfare queen” which fed into the belief by many whites that black people are eating up the economy; their access to entitlements are a big part of the blame for the shoddy economic condition of this country, many will say, and any attempt dissuade people of those beliefs usually meet with rabid and bitter opposition.

OK, so I get that …but why, if one talks about the reality of racism in this country is one branded a “racist?” Why is the worst thing to talk about in America race, when our sick racism is at the base of so many of our problems?

In a book entitled To Ask for an Equal Chance, author Cheryl Lynn Greenberg talks about the state of African-Americans during and leading up to the Great Depression. She cites United States Supreme Court decisions few of us know anything about, like Grovey v. Townsend (1935), which said that electoral parties are private groups and can exclude African-Americans from membership and participation, and Norris v. Alabama, (1935) which allowed for the routin exclusion of African-Americans from jury duty. She talks about the “Atlanta Six” who were arrested in 1930 under a slave statutes against inciting insurrection for organizing protest. In The Worst Hard Time, by Timothy Egan, an amazing book which describes the dust bowl of the 1930s, there is a description of signs put out advertising scant employment opportunities, but signs which clearly said “colored need not apply.”

The foundation of America was sewn with racist and with sexist threads…so why can’t we talk about it without being called “racist?

I cringed when, after Trayvon Martin’s case garnered national and international attention, and President Barack Obama made the statement that if he had a son, he’d look like Trayvon, the accusations of him playing the race card flew as though the card game had been set upon by a great, unexpected wind. Those protesting said he was not only playing the race card, but that he was sowing division amongst or between the races, because this is an election year.

The truth of the matter is that racism has been brewing just under the surface of our American political scene since the president was elected. Congressman Joe Wilson’s rude “you lie!” outburst at the president’s first State of the Union speech was beyond comprehension; the tactics of the Tea Party, including some who reportedly  spit on revered African-American leaders, was steeped in race.

The truth of the matter is, not talking about race has only made the situation worse. Everybody wants to pretend that “it” isn’t racism that is driving some of what we are seeing and hearing today, but it is…We can’t keep agreeing to be silent. We need to face it and shake out the blanket of American democracy. The wrinkles caused by racism need to go…but if we keep the blanket all balled up, the wrinkles will only become deeper.

Silent at Our Own Risk

It amazes and bothers me that we in this country are so reluctant to talk about race and racism.

I spoke this week at an event which I thought would be predominantly white; the sermon was about how we who love God ought to choose God and serve God over racism, sexism, militarism, materialism, homophobia …I didn’t say it, but those things in the list could be, and should be, classified as “sin” since sin is anything that separates us from God.

The audience turned out to be predominantly African-American, and I am more than sure that, while the message resonated with the African-Americans, many of the white people in attendance were probably offended.

Wow.

I know by now that we all see things through different lenses, lenses tinted by our life experiences, but in this, the 21st century, where racism is as ugly and as blatant as it has always been, shouldn’t we be able to try to see through a more common lens so that we can graduate from the halls of racism to a graduate school of peace, understanding, and reconciliation?

In the sermon, I mentioned the feeling of sadness I have as concerns the Trayvon Martin case; I mentioned that I am saddened at the news that at least 40 public schools in urban Philadelphia are scheduled to be closed; I mentioned that it is difficult to listen to people talk about being pro-life when their definition seems only to extend to unborn fetuses and not to children already born, living in horrible situations with horrible education and little to no health care.

I mentioned that the treatment of President Barack Obama has been sickeningly racist, evidence of our still-sick society as concerns race.

I mentioned the horrible chasm that is only widening between the haves and the “have-nots,” relaying disturbing insights about our economic recession that I learned on PBS’s Frontline program, the first part of which aired last week and the second part which will air May 1,  Money, Power and Wall Street . In that program. I shuddered as I listened to the narrator share that in the mortgage crisis, some people with sub-prime mortgages paid as much as 42 percent interest.

I was floored…and I said as much. That has to bother somebody, right? It has to at least bother those who say they love and serve God…or so I posited.

My point was that people who say they believe in God in general, and in Jesus specifically, have a moral code that we should follow; we are mandated to take care of “the least of these,” and because doing that involves challenging political systems, we should choose to serve God and what God would mandate, so that we have the strength to challenge social and political systems which will not change without such a challenge. We get tired of pushing against the powers and principalities which push us right back.

We are not, however, allowed to be tired to the point of inaction. That’s what I shared.

I believe in what I preach; I believe that Christians miss the boat when we are silent about systems, belief systems as well as social and political systems, which permit people to be oppressed and treated unjustly. While, according to Reinhold Niebuhr, who wrote Moral Man and Immoral Society, it is understandable that our society (and in fact, any society) is more immoral than the individuals within it, the way I have learned and internalized Christianity is that we are to work on our personal salvation so that ultimately, we can influence yet another person to take the person and presence of Jesus seriously and get him/her to work against oppression, from whatever source it may come.

I am not sure many agree with me. I sat down yesterday I was not sure where the message had fallen. The African-Americans in attendance, and many of the whites, seemed to understand what I was getting at, some whites, I noticed, avoided my gaze.

Recognizing injustice is hard; fighting it is even harder. It is work that makes us come face to face with our feelings and beliefs, and sometimes, that just doesn’t feel good.

One of my colleagues will share with me the “white” reaction to what I shared yesterday.

My prayer is that one day, there won’t be such a division between races in hearing words about realities that still sit with us, like racism. It has had a dominant place in our society for far too long.
